Welcome to Goodlife Health Clubs. To ensure that Goodlife is able to provide a safe and comfortable environment for all members and staff, please assist us by complying with the following conditions. We advise you to only sign this Agreement if you understand and agree to abide with these conditions. The information outlined in these terms and conditions can and will be used in the event of a discrepancy.
By signing the Agreement you acknowledge and agree:
You have been given a copy of this Agreement and agree to abide by your obligations in it;
You are medically sound to undertake a normal course of exercise, you use the Club facilities at your sole risk and responsibility and you are aware that exercise is physically demanding and participation in some activities offered by Goodlife may pose a risk to your health; and
This Agreement also relates to your authority to any third party payment provider nominated by Goodlife from time to time to direct debit your nominated bank account or credit card for any instalments or fees due under the terms and conditions of that nominated third party payment provider’s Direct Debit Request and Services Agreement (DDR) provided to you. As a member, you can use our Club in line with these terms and conditions, including the Club code.

You, Your, Member: You, Your, Member refers to the name in which the membership has been created, which at times may differ to the party paying for the membership, and includes the parent or guardian of the Member if the Member is under 18 years.
Club: Refers to any Goodlife club your membership entitles you to visit.
Home Club: The Goodlife club where you joined. Your Home Club is named on your Agreement.
Agreement: This is the Agreement between Goodlife Health Clubs and you, under which you will become a member of Goodlife.
Minimum Term: The term specified in the Agreement form.
Code: Code for operating equipment, opening hours and behaviour in the Club, specified in these terms and conditions, and in Club signs and handouts.
Third Party Payment Provider: is the third party payment provider nominated by Goodlife from time to time, currently being DebitSuccess Pty Ltd at 520 Bourke St Melbourne 3000Phone: 1800 148 848. E-mail: [email protected].
Website: “Website” means the Goodlife website at www.goodlife.com.au or such other website as notified to Members from time to time.
Free Time: “Free Time” means that period of your membership contract in which you are not required to pay membership fees but have your usual Club access rights.
Corporate Partners: A company who holds a partnership agreement with Fitness and Lifestyle Group or Goodlife and agrees to subsidise a portion of the full membership fees for its employees/members.
Supply Period: The supply period for a periodic or fixed term agreement is the Minimum Term and is a minimum of two weeks.
Periodic Agreement: The membership is for the supply of the prescribed goods and services on an ongoing basis and will continue until terminated by you or Goodlife.
Fixed Term Agreement: The membership is for a fixed term only and if further membership periods are required a new agreement will be required.
Upfront Membership: The membership is a Fixed Term Agreement paid for in totality upon commencement of the Agreement.
This section constitutes an Agreement summary for understanding our membership options: We note that this Agreement is subject to a cooling-off period, as outlined in clause 18 of these terms and conditions.

Understanding our membership options: Membership Commitment
Note: Some membership options are not available at all clubs. All Agreement fees include goods and services tax (GST). Your fees will change in line with any government GST rate changes, even if you are within your Minimum Term.
All queries and comments about the services provided under this Agreement should be directed to the Home Club via the contact details listed on our website.
All queries and comments about the direct debit billing service should be directed to the Third Party Payment Provider.
Where the member elects to pay by way of direct debit, the member acknowledges that the Third Party Payment Provider has been engaged by the Club to collect the fees due under this Agreement and the member further acknowledges that the member’s contractual relationship with the Third Party Payment Provider is separate to this Agreement.
All members must present their membership card (or photo ID) upon entry to the Club at every visit. If you attend the Club without your access card or photo ID we may refuse your entry.
You must scan your membership card or digital access pass and register your attendance for safety, security and insurance purposes.
Your access card is our property and you cannot lend your card or allow anyone else to use it.
If you lose your membership card or key tag, a replacement can be purchased from Reception upon providing proof of identification.
Upon joining Goodlife, a photo will be taken of you for safety and security reasons and the photograph will be used and stored in accordance with our Privacy Policy www.goodlife.com.au/privacy-policy/
All ‘guest visitors’ to Goodlife Clubs are required to present photo identification upon every visit, complete the guest register, and otherwise comply with our general conditions of entry and Club code as contained in these terms and conditions.
To assist us in maintaining a safe and comfortable environment for all members and staff, you are required to abide by the following conditions. Failure to abide by these conditions may result in the suspension or termination of your membership.
ENTRY: Entry will be refused or you may be requested to leave the Club if:
You are using abusive or threatening language or behaving in a threatening way; or
You are under the influence of drugs or alcohol; or you instruct other members when Goodlife has not authorised you to do so; or
You behave in another way that is considered by Goodlife to be risky or seriously inappropriate.
NON-SMOKING: Our Clubs are non-smoking facilities. The smoking of cigarettes or electronic cigarettes (e-cigarettes or vapes) is strictly prohibited.
TAILGATING: You must not admit any unauthorised person to the Club or to exclusive facilities within the Club, such as Revive or Black Label change rooms. If you breach this obligation, you will be notified by the Club and a tailgate fee of $100 will be payable to the Club. Subsequent breaches of this obligation will incur additional tailgate fees, and membership cancellation. Certain memberships and facilities have age restrictions. Please refer to the Age Policy.
RELAXATION ZONES: Sauna, spa and relaxation zone areas are available in selected Clubs for male and female use and as such minimum standards of dress apply.
WET AREAS: If the Club has any wet areas, such as a swimming pool, sauna, steam room or spas, you may use them. Normal pool safety rules apply for the safety and convenience of all users. These rules are set out on each Club’s pool deck. Pool areas are not supervised and you use them at your own risk. You must follow all signs and never run, dive or jump. Please also supervise children closely. For your own safety, the pool/spa and relaxation zones cannot be accessed during unstaffed hours in a 24.7 club.
SUITABLE CLOTHES: All members and guests must wear suitable clothes and enclosed sports shoes in any exercise areas, except for wet areas. We do not allow clothes with offensive images or inappropriate advertising. If a laundry service is part of your membership, we only wash clothes worn while exercising in the Club. We do not wash underwear. Please label any clothes clearly with your name and check they are machine washable and colour fast.
TOWELS: You are required to use a clean towel when participating in classes and when exercising on gym equipment (including exercise mats) to maintain our hygiene and safety standards. You may be requested to cease training if you do not use a towel. Subject to availability, you may purchase or hire a towel from reception.
CAMERA USE: You must not use cameras in our Clubs without our permission. Taking photos or videos of other members without their consent is a breach of our terms and conditions.
PARKING: You park in the Club’s car park or on the Club premises at your own risk. To the extent permitted by law, we are not liable for any loss or damage to your vehicle or its contents.
PERSONAL TRAINING: Personal training services are available in Clubs for an additional fee. Please contact your Club for more information or see the personal training noticeboard available in Club and make contact with one of the personal trainers directly. Our personal trainers within Goodlife may be contractors, franchisees or employees. If they are contractors or franchisees and not directly employed by Goodlife then all arrangements for personal training services and payments (with the exception of purchase of Goodlife offered PT packages or add-ons) should be made directly with the personal trainer. Please note only authorised Goodlife registered personal trainers are permitted to train members in Goodlife Clubs. Conducting personal training within a Goodlife Club without being an approved personal trainer may result in the cancellation of your membership.
You are required to return equipment to their original state when you have finished, including:
Return weights and bars to their rack.
Unload plates from machines and bars.
Return equipment to its storage location in group fitness classes.
For the safety of you and others, please follow all equipment operating and safety instructions on the equipment.
If you are not sure of correct use or operation of equipment please seek assistance from a team member.
Where functional training zones are available please seek assistance from a personal trainer if you are unfamiliar with the equipment or its safe and appropriate use.
As a courtesy to other members, please use a clean towel when using equipment and keep phone calls to a minimum.
Lockers are available and are located in the change rooms, however lockers are NOT security devices.
To the extent permitted by law, Club employees or contractors are not responsible for any loss of, or damage to, personal property from the Club or a locker. We also recommend that you keep all valuables with you while using the Club.
Damage to, or the loss of locker keys, cards and tokens, will incur a reasonable charge to repair the damage or replace the item.
The Club is unable to look after your personal possessions (keys and wallets for example) whilst you are in the Club.
Bags are not permitted on the gym floor for safety reasons.
As lockers are cleared daily, personal items are not permitted to be stored in lockers overnight. Any items remaining in lockers or items that have been handed into Reception will be held for two weeks and then donated to charity.
If you have joined on a 3, 6, 12 or 18 month membership term then, after your minimum term has expired, your membership fees may increase automatically by 3% from the next direct debit date and annually thereafter.
If you have joined in South Australia on a periodic agreement, we will notify you of membership increases at least two weeks prior to any such increase either by a newsletter, poster displayed in the Club or written notification using the most up to date physical or email address you have given us.
Membership at Goodlife Health Clubs entitles you to:
Work out as many times as you wish in a given period, subject to any restrictions in your membership type relating to Club access outside of staffed hours.
Participate in normally scheduled group fitness classes. However, please note additional fees may apply for specific group fitness programs or challenges. Please refer to Goodlife’s website for more information in relation to these additional offerings.
Use exercise equipment located on the gym floor and cardiovascular training areas.
Where applicable, use the other facilities including pool, steam, sauna and other relaxation zone facilities.
Where applicable, use squash, tennis and volleyball facilities. Additional fees may apply.
There are variations in the facilities and services provided at different Goodlife Clubs. To ascertain exactly what the Club provides in addition to the above entitlements, please enquire at the Club directly. There may be additional fees charged to access these facilities and services.
Goodlife reserves the right to make changes to exercise equipment supplied in any of its Clubs at any time or the group fitness timetable at any time (i.e. alter class type, times and instructors).
You may be eligible to join on a membership that is discounted as a result of an agreement with a Corporate Partner. If Goodlife’s agreement with that Corporate Partner and/or your employment/membership with the Corporate Partner ceases, we may, at our discretion, revert your membership to the agreed full standard rate for the remainder of your minimum term. If this occurs as a result of Goodlife’s agreement with that Corporate Partner ceasing then we will provide you with notice as soon as practical by mail or email (at our choice) using the most up to date physical or email address you have given us.
Minors between the ages of 14 to 17 years may be eligible for a membership subject to the following age policy and the following general terms and conditions:
The minor must comply with all safety requirements of the Club as communicated to the member from time to time;
The minor’s membership may be cancelled for any inappropriate behaviour, misuse of equipment or failure to comply with safety requirements;
The minor must comply with the applicable sections of the age policy;
All minors must leave the Club immediately once staffed hours have ended; and
All minors can only access the Club during staffed hours, subject to the qualifications and exclusions listed in the age policy.
AGE POLICY
14 years
Membership is permitted only with the consent and signature of the minor’s parent/legal guardian.
The parent/legal guardian assumes legal responsibility for performance of the minor’s obligations under this Agreement.
Access is permitted only during staffed hours and the minor member must be accompanied by their parent, legal guardian, suitably qualified personal trainer or other approved exercise professional.
Access is not permitted during unstaffed hours.
Members in this age group are not eligible to redeem Trial or Guest Passes or similar promotions.
Permitted usage for this age group is as follows and subject always to the above conditions:
Non weight-based group fitness
Cardio equipment
Other equipment prescribed by a medical or exercise professional
15 years
Membership is permitted only with the consent and signature of the minor’s parent or legal guardian.
The parent/legal guardian assumes legal responsibility for performance of the minor’s obligations under this Agreement.
Access is permitted only during staffed hours but the minor member is not required to be accompanied by their parent or legal guardian.
Access is not permitted in unstaffed hours.
Members in this age group are eligible to redeem Trial or Guest Passes or similar promotions provided that their parent or legal guardian attends the Club on first visit and signs as guarantor on waiver.
Permitted usage for this age group is as follows and subject always to the above conditions:
All group fitness classes
All challenges
Weight-based equipment
Cardio equipment
16 and 17 years
Membership is permitted only with the consent and signature of the minor’s parent or legal guardian.
The parent/legal guardian assumes legal responsibility for performance of the minor’s obligations under this Agreement.
Access is permitted during both staffed and unstaffed hours and the minor is not required to be accompanied by their parent or legal guardian.
Members in this age group are eligible to redeem Trial or Guest Passes or similar promotions provided that their parent or legal guardian attends the Club on first visit and signs as guarantor on waiver.
All classes and equipment are available, subject to any medical advice.
MEETING YOUR RESPONSIBILITIES
Your responsibilities, including payment of membership fees, do not depend on how often you use a Club.
You must tell us about anything that affects your membership, and any changes to your contact information and bank details.
You must inform us in advance and in writing if there are any risks to your health if you participate in fitness services and if required seek approval from your Doctor or General Practitioner.
PROMISING TO TAKE CARE
You promise to:
Make sure that you know how to exercise safely, by asking if necessary;
Use your best endeavours to exercise safely; and
Not take valuables into the Club, even if you plan to put them in a locker.
DAMAGE & PERSONAL INJURY
To the extent permitted by law, Goodlife Health Clubs exclude any liability to the member in Agreement, tort, statute or in any other way for any injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by the member and/or any other person, or for any costs, charges or expenses incurred by the member, arising from or in connection with this Agreement and/or the services/products provided by Goodlife Health Clubs and/or any act or omission of Goodlife Health Clubs.
OUTSIDE PROVIDERS
Contractors, tenants and franchisees provide some services in our Clubs, such as personal training, physiotherapy and massage (Outside Providers).
You will need to pay service fees directly to the Outside Providers and we are not responsible for those fees or for any associated costs or refunds. Claiming against Outside Providers:
Any service provided by an Outside Provider is a contract between the Outside Provider and you and we to the extent permissible by law, we do not accept any responsibility for a breach of contract or negligence.
If you make a claim because of something an Outside Provider has or has not done, your claim should be brought against the Outside Provider, not us, whether you have paid them or not. To the extent permissible by law you release us from any claim resulting from an act or omission by an Outside Provider.
Asking for our help
Wherever we can, we will help you to resolve issues with Outside Providers. We will also make sure that personal trainers in our Clubs have up-to-date qualifications and insurance. We only allow personal trainers from the Club franchise to work in our Clubs.
If there are special conditions or benefits relating to your membership type, these will be either attached to your Agreement and/or displayed on the website and form part of your Agreement.
If your membership entitles you to Free Time, you will not be charged your weekly fees for use of the Club during the specified period of Free Time. Free Time will not form part of the minimum term of the membership (other than in South Australia and the Australian Capital Territory).
If your membership entitles you to a Discounted Price as indicated in the Fees section of your membership agreement, the Discounted Price will be the price that you will be charged for the duration of payments as indicated by the Discounted Price section. After the specified Discounted Price duration has lapsed, your Fees will revert to the price that is indicated within the Fees section for the remainder of the Minimum Term (if applicable), or ongoing for the remainder the membership, which is subject to change in accordance with the terms of the agreement.
This term applies only to Upfront Memberships. When your Upfront Membership is due to end you can renew your Upfront Membership at the current membership rate as advertised by Goodlife Health Clubs at the time of your membership renewal. By renewing your Upfront Membership, you agree to the membership terms that apply at that time.
If you wish to cancel your Upfront Membership for any reason indicated in Section 18 we will refund you 100% of the value of the unexpired term remaining on your Upfront Membership less any applicable cancellation fees as soon as practicable (and within 7 days of termination where legally required).
If there are repeated failures to meet your payment obligations (other than through the fault of Goodlife or its payment provider), without prejudicing Goodlife’s rights to recover any overdue payments, your membership may be suspended or terminated by written notice to you. All entitlements and entry into any club may be revoked if your account is in arrears and you fail to resolve the debt after being provided reasonable notice.
If your automatic direct debit reverses or is returned to us by your financial institution the following process will apply:
The Club will attempt to contact you about retrying the debit.
If the debit remains outstanding it will be processed within 14 days of the reversal with any late fees that apply.
If you fail to pay us the fees by the due date, we are entitled to refuse you entry to the Club.
If unpaid fees remain outstanding and after attempts by us to rectify the arrears, your membership may be forwarded to a third-party debt collector for further action.
If paying by direct debit, upon default by you in regard to any obligation under this Agreement and failure to remedy the default after notification by Goodlife : you authorise Goodlife to notify any third-party debt collector of the default.
A cancellation request should be provided to the Club as follows:
COOLING OFF PERIOD
Your membership is subject to a seven (7) business days cooling off period.
The cooling off period applies to new memberships only and does not apply to membership transfers or renewals.
The cooling off period starts from the date the Agreement is entered into (the date the Agreement is signed) and ends at close of seven (7) business days later.
Your membership can be cancelled during the cooling off period by contacting your Home Club via the Club contact details as listed on the website.
All monies paid will be refunded with the exception of a reasonable administration fee which shall be payable by you if your membership card and/or 24.7 access pass or any other merchandise you received on joining are not returned within seven (7) days of termination of your Agreement.
PERMANENT SICKNESS OR PHYSICAL INCAPACITY
You may terminate your Agreement before the expiry of the Minimum Term if you are sick or incapacitated and time freeze is not a suitable option for your circumstances. You must show us a current certificate from a qualified medical practitioner stating that you cannot utilise any fitness services or facilities foreseeably because of your permanent illness of physical incapacity.
BANKRUPTCY
You may terminate your Agreement before the expiry of the Minimum Term (payment amount) if you are bankrupt and a time freeze is not a suitable option with regard to your financial circumstances. To terminate your Agreement for this reason, you must provide Goodlife with evidence of a Notification of Bankruptcy from the Australian Financial Security Authority (AFSA), confirming your bankruptcy.
CANCELLATIONS AFTER COMPLETION OF MINIMUM TERM:
There will be a period of notice of 30 days (or 14 days notice if you are a member based in Australian Capital Territory and/or South Australia ), unless otherwise specified, from the date of cancellation request to the date of termination, during which any payments that fall due must be paid in full.
The notice period will exclude freeze or payment break time applied to your membership.
Any instalments/fees due at the date of termination (including instalments/fees which fall due during the notice period) will remain a debt owed to and recoverable by Goodlife Health Clubs and/or their third-party debt collector.
PERIODIC MEMBERSHIP AGREEMENTS:
If your contract is designated as an ‘periodic membership’ on the front page, you acknowledge that unless you provide notice of termination of your membership prior to the end of the minimum period your membership fees will continue to be deducted until you give us 30 days notice of your intent to end your membership (or 14 days in the case of Australian Capital Territory and South Australia members).
If your contract is designated as a ‘fixed term membership’ you acknowledge that it will terminate at the end of the term displayed on the contract unless you renew prior to that date.
For ACT Members Only: I acknowledge that unless I provide written notice of termination of my membership prior to the end of the fixed term of my Periodic Billing Agreement, I will still be liable for my membership fees until 14 days after I provide written notice of termination to the Fitness Centre. I understand the Fitness Centre must respond to its receipt of a written notice within 7 days.
CANCELLATION FOR ANY OTHER REASON (within Minimum Term):
You may terminate your Agreement before the expiry of the Minimum Term (or payment amount) if all instalments and fees due up to the date of termination are paid and the relevant cancellation fee is paid in full at time of cancellation request. The cancellation fees for all membership options (except Black Label or Platinum Plus) are as follows:
If there is 12 months or more of membership fee equivalent remaining on the Minimum Term of the Agreement = $295.
If there are less than 12 months but more than 6 months of membership fee equivalent remaining on the Minimum Term of the Agreement = $245.
And, if there are less than 6 months of membership fee equivalent remaining on the Minimum Term of the Agreement = $195 OR the amount of the future membership fees payable whichever is the lesser).
The cancellation fees for any Black Label or Platinum Plus membership options (including Arena and Reform) are as follows:
If there is 12 months or more of membership fee equivalent remaining on the Minimum Term of the Agreement = $345
If there are less than 12 months but more than 6 months of membership fee equivalent remaining on the Minimum Term of the Agreement= $295.
And, if there are less than 6 months of membership fee equivalent remaining on the Minimum Term of the Agreement= $245 OR the amount of the future membership fees payable – whichever is the lesser.
You can cancel your membership by:
Speaking to the team at reception or calling your home Club. To find your home Club refer to the website https://www.goodlife.com.au/clubs.
Confirming your request. When you do this, please always:
Give us your email address so we can confirm your request in writing; and keep a copy of your request.
You may be liable for further damages for breach of contract if you terminate the Agreement in a manner not described in the Agreement.
TERMINATION BY THE CLUB:
The club reserves the right to terminate this Agreement in any of the following circumstances:
You fail to abide by any of the criteria listed in the conditions of entry (posted in your club) after being notified of any failure;
You fail to abide by the obligations listed in this Agreement and the breach/non-compliance is incapable of remedy or you fail to remedy the breach/ non-compliance within 14 days of being notified by Goodlife Health Clubs or you continue to breach this Agreement;
If we reasonably believe that you have engaged in conduct that infringes on the health, safety or wellbeing of any other members or staff;
The temporary or permanent closure of the Club where a suitable replacement club is not available for the membership to transfer; or
To protect the health and safety of you or other members.
In the event of a termination under this provision and where appropriate, Goodlife will refund to you a proportion of fees paid under any Upfront Membership representing the unused portion of the Agreement less any applicable cancellation fees.
For SA Members: Please cancel any direct debit authorisation for payments under this agreement for: Periodic Agreement: upon termination of the agreement; or Fixed Term Agreement: either at the end of the fixed term or on earlier termination.
TERMINATION BY THE MEMBER
Members are permitted to terminate this Agreement, without incurring a cancellation fee, in the following circumstances:
Where these terms and conditions are varied in accordance with clause 25 or a club code is changed and you are adversely affected by the change. For the avoidance of doubt however, changes to club timetables, facilities, equipment and hours of operation do not permit you to terminate this Agreement under this clause.
If we breach our obligations to you and we do not fix the breach in a reasonable time after you have told us about it in writing. We will refund you any membership fees you pay between the date of notification and the date on which we decide that we cannot fix the breach.
Where there is a permanent closure of the Club where a suitable replacement club is not available for you to transfer.
You can freeze your membership for a minimum period of 2 weeks, up to a maximum of 4 weeks each calendar year at a cost of $5.00 per week (unless a different fee is specified on the front of this Contract).
You must first contact the Third Party Payment Provider at least 3 days prior to the start date of the freeze.
If your membership type provides for a free membership freeze, no fee shall apply for the period of the membership freeze.
After the period of free membership freeze (if any) in your membership type, any additional freeze shall be charged at a cost of $5.00 per week (unless a different fee is specified on the front of this Contract).
Before freezing your membership, you must make sure your fees are up to date and there are no arrears outstanding on your account.
Please note that if you are within your minimum term, any time freezes are not classified as a full payment toward your contract and so your Minimum Period will be extended by the length of any freeze.
Note that we cannot backdate any time freeze requests. You must request a freeze three days prior to the start date of the freeze.
TIME FREEZE FOR CLUB CLOSURES
If we are required by the state or federal government to temporarily close our clubs in your local State (Closure Period), we will freeze your membership for that Closure Period. If this occurs:
You are entitled to request cancellation of your membership during the Closure Period (applicable cancellation fees will apply) but processing of the cancellation may be delayed until after the Closure Period has ended.
Please refer to section 18 regarding the terms that apply to cancellation of your membership.
In addition, if the Club is closed for a period of more than one week (e.g. due to refurbishment) and there is no suitable alternate club available for you to use then you may request that your membership be frozen until the Club re-opens (Closure Period).
Any membership freeze which occurs as a result of a Closure Period does not:
Count as part of a member’s Minimum Term/ Supply Period; and
Cause a reduction in the member’s entitlement to a free membership freeze (if any).
Unless the law requires otherwise, membership freezes which occur as a result of a Closure Period are not classified as a full payment toward your contract ,and will incur a fee of $5 per week which will afford you ongoing access to the digital workout tools offered by Goodlife by app or portal.
You can transfer your membership to another person (transferee) within the Minimum Term of your Agreement so long as the transferee:
Is not a current member;
Has not been a member in the last 3 months;
Completes the new membership sign-up process;
Is eligible to take up your membership (for instance, you cannot transfer a corporate or concession membership to someone who would not qualify for that membership); and
Has not previously been banned from Goodlife Health Clubs or failed to pay membership fees.
The transfer is effective only after the transferee has completed the sign-up process. Transferees of a membership are subject to the same membership terms and conditions as the transferor.
We do not allow transfers once you have completed your minimum term. You also cannot transfer foundation, family or friends memberships.
24.7 ACCESS PASS
All members are required to complete the Club's safety induction before they can access the Club outside of staffed hours.
For member’s safety, you cannot ask another member to provide you with access to the Club in unstaffed hours.
You must not admit guests or in any way facilitate unauthorised access to the Club. If you breach this obligation, you will be notified by the Club and a tailgate fee of $100 will be payable to the Club. Subsequent breaches of this obligation will incur additional tailgate fees, and risk revocation of 24.7 access and membership cancellation.
If you deliberately use the emergency system inappropriately, you agree to pay any costs, loss or damage incurred because of the inappropriate use.
GENERAL INFORMATION
You will read and follow all safety instructions displayed on equipment and throughout the Club.
Relaxation areas including sauna, steam room, spa and pools and any alarmed areas are strictly out of bounds during unstaffed hours.
Do not bring valuables into the Club. Any belongings that you choose to bring into the Club should be kept on you at all times or secured in the lockers provided.
The Club will take no responsibility for lost or stolen items.
The Club is monitored by Closed Circuit Television (CCTV) at all times.
You acknowledge and understand that CCTV will be installed in appropriate areas within each club and surrounds as a strategic component for team member, member and contractor safety and crime and misconduct prevention.
By entering our club, you consent to being filmed under CCTV for these purposes and understand that we will only use and store your image in accordance with our Privacy Policy.
Depending on your choice of membership, you may be eligible to receive one quarterly coaching session with a Goodlife fitness professional nominated by Goodlife.
The quarterly coaching session shall be conducted in one x 30 - 45 minute appointment and is subject to the availability of the fitness professional.
Per the Special Conditions of your membership, an additional quarterly fee may apply.
If a quarterly fee is payable, it will be charged by direct debit once per quarter (if on a direct debit payment schedule), or it will be included in your total upfront payment if you have a paid-in-full membership;
To the extent permitted by law, it is non refundable. The full inclusion details and terms are as set out in the Special Conditions on the Goodlife website.
The Account Service Fee is charged to Goodlife accounts on a quarterly basis and includes but is not limited to maintenance of the following services:
Account billing services
Access management
Membership Transfer
Membership Portal services
Goodlife App
Your safety and the safety of other members and our staff is of utmost importance to us and we may, from time to time, introduce reasonable health and safety measures (including for example temperature checks prior to accessing our facilities in response to COVID-19) to ensure your safety and safety of other members and our staff. If we make any reasonable health and safety measures a condition of entry and you refuse to comply with these measures, you may not be permitted to enter the Club at our discretion unless a medical exemption applies (and we are provided with appropriate supporting documents).
We may sometimes change our terms and conditions. This includes changing a club’s opening hours, its services and facilities and membership fees. Sometimes, we may also close clubs for refurbishment. We do not reduce your membership fees because your club is closed for renovations or repairs (where a suitable substitute club is available) or for a public holiday. The most up-to-date terms and conditions always apply. You can find copies at your local club or on our website https://www.goodlife.com.au.
If we reasonably consider that any change to the terms and conditions is likely to benefit you or be of no, or immaterial, detriment to you, we can make the change immediately and do not need to notify you.
For all other changes, we give you at least 30 days notice of any changes, for instance by:
Publishing them in our newsletter or on our website; or
Placing a notice in the Club; or
Calling you or writing to the address (post or email) you last gave us.
If we suspend a club’s operations or services, temporarily or permanently, we may send you a written notice offering you a transfer to another club.
At selected clubs we offer exclusive classes and services that require booking due to limited availability. Bookings can be made via Goodlife website up to seven days in advance. Bookings are limited to three active bookings at any time. You can cancel your booking online up to 2 hours prior. If you book but do not attend the session, you will be notified by email and charged up to $10 for a no show fee. Entry after the session has started maybe refused by Staff.
We can assign or transfer the benefit of your contract to a person, firm or company at any time, provided we are reasonably satisfied that the person, firm or company is capable of performing its obligations under this contract. We will give you 30 days’ prior notice in writing.
We can also sub-contract our obligations to someone else without notice to you. But if we do, we are still responsible for ensuring those obligations are met.
Your “personal information” (as that term is defined in the Privacy Act 1988 (Cth)) will only be used by Goodlife Health Clubs in accordance with the provision of their Privacy Statements.The Goodlife Privacy Statement can be obtained from its website www.goodlife.com.au.
MARKETING PERMISSIONS
We sometimes film or photograph the Club so it is possible you will appear in the background. By signing your Agreement, you allow us to use your image in promotional and other business-related material.
Goodlife will use the contact details you have provided above to contact you about your membership. Goodlife, related companies and companies we engage to perform services on our behalf, may also contact you from time to time both during and after your membership with information about fitness and wellness, promotions, special offers and other materials about Goodlife and related companies' service and products. Goodlife will not provide your personal information or contact details to unrelated third parties. Depending on your preferences, you may be contacted in the following ways: mobile, email and/or SMS. You can change your mind at any time about receiving marketing materials by contacting Goodlife Health Clubs at [email protected].
This Agreement and its Annexures and any Special Terms & Conditions listed on the website constitute the entire agreement, understanding and arrangement (express and implied) between the Member and Goodlife Health Clubs relating to the subject matter of this Agreement and supersedes and cancels any previous agreement, understanding and arrangement relating thereto whether written or oral.
The following changes are to be effective from 3 July 2023.
Group Fitness Class No-Show Fee (Clause 27): A new no-show fee of up to $10.00 has been introduced for members who book a Reform or Arena group fitness class, but do not show up to that class. Bookings may be cancelled at least 2 hours prior to the commencement of the class. If a member fails to cancel and does not show up to the booked class, they will receive an email notification advising them that a $10.00 fee has been charged to their account.
Memberships through Corporate Partners (Clause 11): The circumstances in which a member who holds a discounted membership through a Corporate Partner have been updated. In the event that the Agreement between Goodlife and the Corporate Partner expires or terminates, Goodlife may, in their reasonable discretion, revert a membership to the full standard rate for the remainder of the minimum term for that membership.

Third Party Payment Provider: Goodlife's Third Party Payment Provider (DebitSuccess/XPLOR) has updated its terms and conditions for Goodlife members. Their new terms and conditions are separate to Goodlife membership agreement and will no longer appear on Goodlife’s website. These Special Conditions form part of the General Membership Terms & Conditions between Goodlife Operations Pty Limited (A.B.N. 59120953200) and Black Label members who joined between 1 July 2019 and 3rd August 2022 and together constitute your membership agreement.
By signing your membership agreement and accessing the benefits of your Black Label membership, you agree to the Special Conditions contained in this document. To the extent of any inconsistency with the General Membership Terms & Conditions, the terms of these Special Conditions shall prevail.
ARENA AND YOGA BOX ACCESS Black Label members have unlimited access to exclusive additional group fitness classes conducted by Arena Championship Series, Arena Fit Series, Arena Academy, and Yoga Box throughout the term of their Black Label membership only.
ARENA ACCESS & CODE OF CONDUCT Members must abide by the Goodlife and Arena general terms and conditions including, but not limited to, not wearing shoes in the Arena studio, spraying feet upon entry into the Arena studio and bringing a towel, wraps and boxing gloves to all workouts. Arena Academy participants will be required to provide their own equipment that may include but not limited to mouth guard, shin pads, gloves and Gi.
Access to Arena is strictly for Black Label members only and when accompanied by a staff member. Access to the Fit Series area whilst reserved for a class is strictly for Fit Series or Black Label members only and when accompanied by a staff member.
Arena Championship Series and Fit Series classes must be booked through the booking system on the Arena website, otherwise the member may not be permitted to participate in the Arena Championship Series or Fit Series class.
GUEST PASS Members with Black Label Membership are entitled to bring a guest to train for free on Friday, Saturday and Sunday during staffed hours only (“Guest Pass Access Hours”). Members may bring a maximum of one (1) guest per day during Guest Pass Access Hours. Members can bring one (1) different guest for each free visit. Any guests must be accompanied by the member to gain access to the club. Prior to accessing the club, the guest must:
Provide proof of photo identification and sign the guest register;
Provide their name, age address and phone number/email address;
Read, understand and agree to any terms of entry and club conduct; and
Read, understand and agree to any waiver and indemnity required by the Promoter
Guests cannot have been a member of Goodlife Health Clubs (including previous brands Goodlife have acquired) for the past three (3) months.
The Guest can only access and use the club and its facilities in accordance with the Goodlife age policy which restricts access and usage of certain equipment to minors.
The Guest only receives access to non-paid sercices (including gym floor and group fitness) and all paid services are excluded. Paid services include but are not limited to; Arena Championship Series, Arena Fit Series, Arena Academy, Yoga Box, and Small Group Training, Personal Training, 12 Week Challenges, or Bootcamps.
CHALLENGE VOUCHERS Black Label members are granted 4 x $25 vouchers for Goodlife fitness and weight loss challenges, including but not limited to the 12 Week Challenge, and 8 Week Challenge. Only one (1) voucher can be used per challenge.
Challenge vouchers are transferrable and can be transferred to another current Goodlife member.
Challenge vouchers must be applied to the full price entry rate and cannot be applied to any Early Bird or other discounted rate.
Challenge vouchers are not redeemable for cash or any other form of account credit or discount and are valid only during the membership term.
RED LABEL MEMBERSHIP VOUCHERS Black Label memberships are granted 4 x $100 Red Label membership vouchers that entitle up to four (4) of their friends to:
A 21 day Red Label membership to a Goodlife club of their choice; or
Exchange the Red Label membership for a 10% discount off the TTP of the Goodlife membership of their choice. This exchange must occur within the first seven (7) days of the activation by the friend.
Only one (1) voucher can be used per friend. The friend must not have been a member of Goodlife in the last three (3) months. Red Label membership vouchers are not redeemable for cash or any other form of account credit or discount.
MEMBERSHIP FREEZE Black Label members are entitled to one (1) complimentary quarterly coaching session (QCS) with a Goodlife Fitness Professional, subject to the QCS terms and conditions displayed on the Goodlife website.
Every QCS must be booked within fourteen (14) days of the quarterly-anniversary. Outside of this period, the QCS is void. QCS appointments cannot be saved for use at a later date.
Whilst this offer is available to current customers of a Goodlife Fitness Professional, or those who have previously commenced or completed a Goodife Fitness Professional program, the QCS will be subject to availability and Goodlife will nominate a Fitness Professional to conduct the appointment.
ACTIVATE SESSION Upon payment if a $99 start-up fee, Black Label members are eligible for an initial 45 minute consultation with a Goodlife Fitness Professional. Activate sessions must be booked within 14 days of the commencement of the membership.
INDEMNITY The Promoter or the Participating Outlets shall not be liable for any claim, loss or damage whatsoever which is suffered (including but is not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, except for any liability which cannot be excluded by law and the member indemnifies the Promoter and the Participating Outlet in relation to any claim, loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury which is suffered or sustained.
Goodlife Operations Pty Ltd (ABN 59 120 953 200) (Goodlife) is offering two (2) x sessions with a Goodlife Personal Trainer (PT) for $39.00 (subject to any further promotions which Goodlife may run from time to time) (Intro PT Pack).

Failure to give at least twenty-four (24) hours notice of non-attendance to the PT will result in the session being forfeited by the member. The Intro PT Pack is non-refundable.
The Intro PT Pack may be transferred to any eligible member, subject to Goodlife’s sole discretion and on the provision that the transferee has met the conditions outlined in clause 3 of these Terms & Conditions. No administration fee shall apply to the transfer of a Intro PT Pack between members.

Whilst this offer is available to current customers of a Goodlife Fitness Professional, or those who have previously commenced or completed a Goodlife Fitness Professional program: the Quarterly Coaching (QC) appointments will be subject to availability and Goodlife will nominate a Fitness Professional to conduct the appointment. This is subject to change in the event the nominated Goodlife Fitness Professional is not available.
The QC appointment covers a 1 x 30-45 minute appointment with a Goodlife Fitness Professional. Quarterly Coaching is a training review of what training has been effective and what hasn’t; followed by some on-the-gym-floor movement coaching to ensure the member exercises in the safest (injury avoiding) and effective (result proven) ways relative to their goals.
A QC-fee will or will-not apply in accordance with your membership type. Not all membership types include a QC appointment.

As part of the motivation to exercise strategy; booked appointments cannot be cancelled or rescheduled. Failure to give at least 24 hours notice of non-attendance will render the appointment fulfilled.

However, if that direct debit start date is not suitable for you (for example, if the start date was a Monday but you prefer for debits to be deducted on a Sunday), you may select an earlier direct debit start date from the last 6 days of your free time period and your free time period will be reduced by the number of days from the direct debit start date to the last day of your free time period. For example, if the minimum term start date was a Monday but you select for the direct debit start date to begin on the Sunday prior (the last day of the free time period), your free time period will be reduced by one day. If you nominated the direct debit start date to begin on the Saturday prior, your free time period will be reduced by two days. If you nominated the direct debit start date to begin on the Friday prior, your free time period will be reduced by three days.

This Schedule sets out the terms and conditions which govern the Goodlife Health Clubs – Fitmas (Game of Chance). The Schedule must be read together with the Trade Promotion Terms and Conditions of Entry (which follow this Schedule).

Eligible Persons | The Challenge only applies to existing Goodlife Blue, Platinum and Platinum Plus members in the Relevant States and cannot be run in conjunction with any other offer (Participants). Participants must be 15 years old or older to be eligible. Participants in the Promotion under 18 years of age must have the consent of a parent or guardian to enter this Promotion. Directors, management, employees, officers, and contractors of the Challenge who are directly involved in the management of the Challenge (and their Immediate Families) or of the agencies or organisations associated with this Challenge are ineligible to enter. Immediate Families means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer, or contractor. |
Entry Procedure | There is one (1) method of entry into the competition. Participants must attend a Goodlife Health Club twelve (12) times in thirty-one (31) days. Attendance will be recorded at reception of an eligible Goodlife Health Club through its check in software located at reception. Participants are responsible for checking that their Goodlife Health Club membership is active and that their check in is recorded at reception. |

Results | Winners will be randomly drawn for each state via a random computer generator by the Marketing Manager at 176 Montague Road, South Brisbane, QLD. Each winner will be contacted by 5:00 pm AEST on Friday 7 February 2025. All winner’s names will be published on the Goodlife website located at www.goodlife.com.au by Friday 7 February 2025. |
Prize Details | Participants in this Challenge who successfully attend twelve (12) times during the Promotion Period will go into the draw to win one (1) x 12 month membership, equal to value of the winner's current membership. For example, if a winner is currently on a Goodlife Blue membership, the Prize that they will receive is a 12 month Goodlife Blue membership. The 12 month membership prize will be added as a 12 month payment break to each winner’s membership account. A maximum of one (1) x Prize will be available to be redeemed by one winner at each Relevant State. Verification Requirements | The winners will be required to verify their identity and provide proof of age prior to receiving their prize. Identification considered suitable for verification is at the Promoter’s reasonable discretion. |
Prize Restrictions (if any) | A tax invoice or receipt will not be issued to the Winner. The prize is non-transferrable and cannot be exchanged or redeemed for cash. Prize Claim Date | If after three (3) months since choosing a winner, the Promoter has been unable to contact the winner despite making all reasonable attempts, an alternate winner will be chosen through a redraw in the same manner on 18 of April 2025 and published on the website by the 25 of April 2025. If an entrant does not truthfully provide all requested personal information, the Promoter may determine that the entrant is not eligible to win a Prize. The Participant acknowledges and provides their consent for their contact details to be given to the Promoter for the purpose of being contacted by the Promoter in relation to the Promoter’s products and services. |
TRADE PROMOTION TERMS AND CONDITIONS OF ENTRY
1. These Terms and Conditions incorporate and must be read together with the Schedule for the Promotion. The Schedule prevails to the extent of any inconsistencies with these Terms and Conditions. Entry into this Promotion constitutes acceptance of these Terms and Conditions.
2. Promoter: Goodlife Operations Pty Ltd ABN 59 120 953 200 located at 176 Montague Road, South Brisbane, QLD (Goodlife).
3. Any capitalised terms used in these Terms and Conditions have the meaning given in the Schedule, except where stated otherwise. Unless the contrary intention appears, a reference in these terms to the word “person” includes an individual, a firm, a body corporate, a partnership, a joint venture, an unincorporated body or association, or any government agency or entity.
ELIGIBILITY TO ENTER
4. Entry to the Promotion is open to residents of the Relevant State(s) who are Eligible Persons as described in the Schedule and meet the Entry Restrictions (if any).
ENTRY
5. The Promotion will be conducted during the Promotion Period. To enter the Promotion, entrants must complete the Entry Procedure during the Promotion Period.
6. Entries may only be submitted in accordance with the Entry Procedure and will not be accepted by the Promoter in any other form. Computer generated or other automated entries will not be accepted.
7. All valid entries received during the Promotion Period will be entered in the Promotion, and the prize draw, if the Promotion is a game of chance.
8. Once submitted, Entrants cannot alter or delete their entry.
9. Entrants may enter the Promotion up to the Maximum Number of Entries. Multiple entries (where permitted) must be submitted separately and must each separately meet any product purchase requirement specified in the Entry Procedure (if applicable). Excess entries will be deemed invalid.
10. Entries must be received by the Promoter during the Promotion Period. Email and electronic entries are deemed to have been received at the time of receipt into the Promoter's database and not at the time of transmission by the entrant.
11. If the Promotion involves entry via a website, the cost of accessing the website will be dependent upon the Entrant's individual Internet Service Provider.
12. All Entries (including photographs and videos) become and remain the property of the Promoter upon submission and will not be returned to Entrants.
PROMOTIONS CONDUCTED VIA A SOCIAL NETWORKING SITE
13. If the Promotion is conducted via a social networking site (including but not limited to Facebook and/or Instagram), entrants acknowledge that the Promotion is in no way sponsored, endorsed, or administered by, or associated with the social networking site.
14. Entrants acknowledge that any information they provide in connection with the Promotion is provided to the Promoter and not to the social networking site.
15. Any questions, comments or complaints regarding the Promotion will be directed to the Promoter and not to the social networking site.
16. Entrants release the social networking site and its associated companies from all liability arising in respect of the Promotion, to the extent allowable by law.
ENTRY CONTENT AND VALIDITY
17. Incomplete and illegible entries will be deemed invalid. Entries that breach these Terms and Conditions or any other content guidelines notified by the Promoter during the Promotion Period will also be deemed invalid.
18. Entries submitted by persons who are not Eligible Persons will be deemed invalid. The Promoter may not assess each entry however, winning entries will be scrutinised.
19. If an entry is invalid or if an entrant is unable or refuses to take part in any element of this Promotion, the Promoter reserves the right to discard that entrant’s entry and proceed as if that entrant had not entered the Promotion.
20. If for any reason, the Promoter becomes aware after an entrant has won a prize that the entrant has not complied with these Terms and Conditions or that their entry is otherwise invalid, that entrant will have no entitlement to the prize, even if the Promoter has announced them as a winner and that entrant will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize.
21. Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work. If an entry cannot be verified to the Promoter’s reasonable satisfaction, the entry will be deemed invalid.
CONSENTS AND PERMISSIONS
22. By entering this Promotion all entrants: (a) consent to the Promoter using and publishing (and authorising others to use and publish) their name, character, likeness, image, voice or anything else that identifies them for the purposes of any promotion or matter incidental to the Promotion, including future similar promotions, and at any time during or after the Promotional Period and via any means (including but not limited to, any national print media, the Promoter's website and any other promotional material); (b) assign (and, if necessary, will in the future assign) all intellectual property rights (including copyright) in their Entry Materials in relation to all media (including but not limited to, the internet) and whether in existence now or created in the future; (c) unconditionally and irrevocably:
(i) consent to any act or omission that would otherwise infringe any of their moral rights in the Entry Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given;
(ii) waive all moral rights that arise outside Australia; and
(iii) agree not to institute, maintain or support any claim or proceeding for infringement of their moral rights in the Entry Materials; and
(iv) warrant to the Promoter that their entry is the original independent creation of the entrant and free from any claims, including copyright or trademark claims, by other persons.
23. If the Promotion involves the publication of Entry Materials on a website, the Promoter accepts no responsibility or liability where an entrant’s photos, images or other Entry Materials are downloaded from the website by any persons, and for any matters after such download. The Promoter may, in its absolute discretion, edit, modify, delete, remove, or take down any part of an entrant’s entry.
PRIZES - GENERAL
24. If the prize involves a winner meeting or attending a function with a celebrity or other public figure, the Promoter will not be liable for the failure of the winner (and their companion(s), if applicable) to meet that person or failure of that person to attend the function, for whatever reason.
25. The Promoter may, at its discretion, require any person taking, accepting, or participating in any prize to be 18 years or over.
26. The Promoter reserves the right to appoint a chaperone to accompany the participants taking the prize. The participants agree to the chaperone being present with them for the duration of the prize and agree to comply with any reasonable directions or guidelines given to them by the Promoter or their chaperone.
27. The prize must be taken as offered and cannot be varied unless authorised by the Promoter. The prize value includes GST and is in Australian dollars and is correct at the time of printing. The Promoter accepts no responsibility for any variation in prize value.
28. Prizes are not transferable, exchangeable or redeemable for cash. Prizes cannot be sold to a third party including online auctions and private sales. Unused portions of prizes will be forfeited, and no compensation will be paid in lieu of that element of the prize.
29. Subject to the approval process required by any relevant gaming or lotteries authority, if any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value, subject to any written directions from any relevant regulatory, judicial or government authority.
30. Where prizes are lost, stolen, damaged or tampered with, for reasons beyond the control of the Promoter, the Promoter is not liable.
31. Without limiting the above terms and conditions, the Promoter may, at its absolute discretion, substitute cash for any prize (the amount of cash being equal to the prize value specified in the Prize Details).
32. Except to the extent required by any law, including the Australian Consumer Law, the Promoter and its associated companies make no warranties or representations about the fitness for purpose or suitability of any prize and will not accept responsibility for the quality or fitness for any purpose of any prize or the failure of any prize to be of acceptable quality.
33. Prizes and participation in the Promotion are subject to any terms and conditions imposed by the supplier or organiser of the prize, as applicable.
34. These Terms and Conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010 (Cth) where to do so would contravene that statute or cause any part of these Terms and Conditions to be void.
PRIZES – PROVISIONS RELATING TO TYPES OF PRIZES
35. The prize(s) are specified in the Prize Details. The prize(s) are subject to any restrictions specified in the Schedule. The total prize pool is specified in the Schedule.
36. If a prize includes vouchers, the vouchers are only valid until the voucher expiry date specified on the voucher or by the provider and are subject to any terms and conditions imposed by the provider. Once awarded, the Promoter is not liable for any voucher that has been lost, stolen, forged, damaged, or tampered with in any way.
37. If a prize includes tickets, including tickets to an event, the tickets are only valid for the date or period specified on the tickets or by the provider, and are subject to any terms and conditions imposed by the provider. Once awarded, the Promoter is not liable for any ticket that has been lost, stolen, forged, damaged, or tampered with in any way.
38. If a prize includes travel, the prize must be booked and completed as specified by the Promoter or by the supplier of the prize. If the prize is event based, any travel provided as part of the prize must be taken on the dates specified by the Promoter to coincide with the event. The prize is subject to booking and availability and is subject to any terms and conditions imposed by the relevant providers. All costs associated with a travel prize which are not expressly stated in the Schedule to be included, including additional spending money, passport and visa costs, transfer costs, meals, taxes, insurance, luggage costs and all other ancillary costs, are the responsibility of the winner. The winner and any travelling companion(s) must depart and return at the same time using the same air carrier. The winner and any travelling companion(s) are responsible for ensuring they have all necessary travel insurance (if not included in the prize) and documents to travel to the relevant place(s) (including passports and visas, if required). Any alterations or extensions to confirmed prize details must be approved in advance by the Promoter (at its sole discretion) and will be at the expense of the winner. The Promoter is not responsible for the cancellation, delay or rescheduling of any part of a travel prize and any costs incurred by the winner or any travelling companion(s) as a result (including accommodation costs) will be the responsibility of the winner. The winner is responsible for ensuring that they and their travelling companion(s) are fit to travel and have received appropriate immunisations and/or health checks prior to taking the prize. It is the entrant’s responsibility to check and prepare for travel warnings and any perceived hazards with appropriate authorities, including www.dfat.gov.au. The Promoter is not responsible for any illness, injury or property damage that affects the winner while undertaking the travel prize.
39. If the prize involves a winner attending an event, if any part of the event is abandoned, called off, varied, or postponed for any reason, then at the Promoter’s discretion, the relevant winner (and their companion(s), if applicable) forfeits all rights to attend the relevant event and no cash or alternative tickets will be substituted for that element of the prize. If the event is varied or postponed, the Promoter, where reasonable, will try to vary arrangements to allow the winner (and their companion(s)) to attend the varied or postponed event (unless doing so would involve additional costs to the Promoter).
CLAIMING PRIZES
40. Prizes must be claimed by the Prize Claim Date in accordance with any Claim Instructions set out in the Schedule. If a prize is not accepted by, or failing all reasonable efforts by the Promoter, is not delivered to the prize winner, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the unclaimed prizes in accordance with the Unclaimed Prize Arrangements specified in the Schedule, subject to any directions given by any relevant authority. Winners of unclaimed prizes will be notified and have their names and State, or Territory of residence published in accordance with the Unclaimed Prize Arrangements, subject to any directions given by any relevant authority.
CANCELLATION OF COMPETITION
41. If, for any reason, the Promotion or any of the prizes are not capable of being run or offered as planned, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it. Any actions are subject to State and Territory regulations and may include cancellation, termination, modification, or suspension of the Promotion.
42. The Promoter may also cancel, suspend, or modify the Promotion if the determination of the prize winner or the delivery of the prize is prevented or hindered by any external event beyond the control of the Promoter, including but not limited to, vandalism, power failure, tempest, natural disaster, acts of God, civil unrest, strikes or other industrial action. If the Promotion is not capable of being run as planned, for reasons outlined above, the Promoter will not be liable for any loss or damage of any kind to entrants arising out of any resultant action taken by the Promoter.
PRIVACY AND INFORMATION
43. The Promoter may collect the following personal information provided by entrants when entering or participating in this Promotion (including without limitation in their Entry Materials, transactional information, when you shopped, where you shopped, how you paid and what you purchased, address, phone number, name, age, passport number, drivers licence number, information obtained from any Promotion partners, information you provide when submitting any questions or queries regarding the Promotion) or by entrants doing anything in connection with this Promotion.
44. The Promoter may use your personal information to conduct the Promotion, to ask you questions, to contact you about any matter in connection with the business or the Promotion, to contact entrants if they are winners, to conduct research and marketing activities (including to inform entrants about special offers, marketing, events, promotions, product launches and other special events and discounts from the Promoter such as new products or promotions and to become part of databases maintained by the Promoter or associated entities), to conduct market research (including to improve and help Promoter better tailor its product and service offering , including developing new products, services, promotional offers and shopping opportunities) and to conduct market research and other forms of analysis, unless the entrant opted out of participating in such activities in the section provided on the entry form, and otherwise in accordance with the Promoter’s Privacy Policy. If you provide your email address or mobile phone number, you consent to the Promoter using your email address to email you and/or your mobile telephone number to SMS you for any of the purposes listed above
45. Entrants can advise the Promoter at any time if they no longer wish to participate in any such research and marketing activities. Otherwise, their consent will remain current until specifically withdrawn. The Promoter may disclose entrants' personal information for the above purposes to other companies associated with this Promotion, related bodies corporate of the Promoter, the Promoter's information technology providers and database service providers and other entities which provide research and marketing services to the Promoter.
46. The Promoter may engage other persons or organisations (for example, the Promoter’s suppliers, prize donators, competition and promotion agencies, data mail houses, data processing organisations, marketing researchers, specialist call centres and service providers) to assist the Promoter in carrying out the above purposes. Some of these organisations may be located overseas. Your personal information may be disclosed to such persons or organisations for these purposes and, in providing a service, they may contact you directly. In some circumstances, they may disclose personal information they collected from you to the Promoter or one or more of the purposes already mentioned. The Promoter will hold and use all personal information it collects from third parties about you for the purposes described in this notice.
47. The Promoter may also disclose your personal information as required by law.
48. If entrants do not provide the personal information requested by the Promoter, they may not participate in the Promotion (except where the provision of that information is optional). Winners’ names will be published and retained as required under relevant legislation. An entrant may, at any time, request to access, update or correct any information, or to have their details removed from the Promoter’s database(s) and such request will be considered in accordance with the requirements of the Privacy Act. Such requests should be directed to the Promoter at its address set out in item 2. The Promoter’s Privacy Policy can be viewed at https://www.goodlife.com.au/privacy-policy/.
INDEMNITY AND LIABILITY
49. Unless required by any law, including the Australian Consumer Law, the Promoter, its related bodies corporate and their respective officers and employees, its agents, its contractors, its associated entities and their respective officers will not be liable for any loss (including but not limited to, indirect, special or consequential loss, loss of opportunity or loss of profits), expense, damage, personal injury or death which is suffered or sustained in connection with any part of this Promotion (including entry, collation of entrant details, prize draw and determination of the winner(s)), promotion of this Promotion, use or acceptance of the prize or the prize itself, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum extent allowable by law).
50. If requested by the Promoter, any entrant or winner (and their companion(s), if applicable) (or if an entrant, winner or companion is not an adult, their parent or guardian) must sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the prize prior to undertaking any specified activities forming part of the competition, acceptance or use of the prize or the prize itself. If any entrant, winner, nominated companion or parent/guardian (if applicable) does not sign the indemnity form provided by the Promoter, within the time requested by the Promoter, the relevant entrant’s or winner’s entry or claim will be deemed invalid. Where a winner’s entry or claim is deemed invalid, the prize will be deemed unclaimed, and the Promoter has a right to redraw the prize in accordance with the Unclaimed Prize Arrangements in the Schedule.
51. Without limiting the previous paragraphs, the Promoter, its related bodies corporate, its agents and its associated entities will not be liable for any damage to or delay in transit of prizes.
52. If other entities are conducting the promotion in conjunction with the Promoter, the Promoter is not liable for any error made by the other entity when communicating details of the Promotion, the entry process, the prize draw, the prize, determination of the winner and promoting the Promotion.
FORCE MAJEURE
53. The Promoter shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, epidemic, pandemic such as COVID-19, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer, Government edict or regulation (Force Majeure Event).
54. If the Promotion is impacted by a Force Majeure Event, the Promoter will make reasonable efforts to reschedule the Promotion to a later date. If the Promotion is unable to be rescheduled to a suitable date, the Promoter reserves all rights to cancel the Promotion immediately without prior notice to the public or any Participant.
GENERAL
55. The Promoter reserves the right in its sole discretion to verify the validity of entries and to disqualify any entrant (or voter if applicable) who tampers with the entry (or voting process), or who submits an entry which is not in accordance with these Terms and Conditions, or who the Promoter has reason to believe has breached any of these Terms and Conditions, or has engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
56. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
57. The Promoter accepts no responsibility for any tax implications that may arise from acceptance of the prize winnings. Entrants should seek independent financial advice prior to entering the Promotion.
58. The Promoter may at its absolute discretion prohibit an entrant’s participation in this Promotion, cancel or suspend a prize or cease to provide any prize to a winner if the entrant or winner or any companion(s) are, in the reasonable opinion of the Promoter, under the influence of alcohol or drugs, behaving aggressively, disruptively, or in a manner which may diminish the good name and reputation of the Promoter or its products and brands, or are engaging in conduct that is misleading, deceptive, contrary to law or is otherwise inappropriate.
59. The Promoter's decisions in connection with the Promotion are final and no correspondence will be entered into.
60. No responsibility will be taken for unsuitable, lost, deleted, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
61. Entries which are to be published on a website will be subject to a moderation process before being visible on the website.
62. The Promoter may require the winner(s) to provide identification as requested by the Promoter including but not limited to, proof of identity, age, residency, employment, supply to the Promoter or engagement by the Promoter. Identification considered suitable for verification is at the Promoter’s reasonable discretion.
63. Entrants acknowledge that there may be inherent risks in some aspects of the Promotion or the prize and that participation in the Promotion or the prize may involve participating in dangerous activities. By entering this Promotion and/or accepting the prize, entrants accept that risk for themselves and for their companion(s) (if applicable).
64. In order to participate in this Promotion and/or the activities which may be awarded as part of the prize, the winner (and their companion(s), if applicable) must comply with applicable health, fitness, skill, balance, dexterity and any other requirements normally associated with the activity. It is the entrant’s responsibility to ensure that they (and their companion(s), if applicable) are sufficiently healthy and fit to safely participate in this promotion and/or undertake the activities awarded as part of the prize. The entrant or winner must comply with all requirements and directions of the people responsible for the conduct of the relevant activity and must ensure that their companion(s) also comply (if applicable). If the Promoter reasonably believes that the entrant, winner, or their companion(s) will not be able to comply with such requirements, the Promoter may deem the entrant, winner, or their companion(s) not sufficiently healthy or fit to participate in the Promotion.
